Client Guide & Courtroom FAQs
Key legal concepts and answers to common procedural questions.
Do I need to appear in court on every hearing date?
No. In regular procedural hearings (e.g., summons issuance, interim injunction arguments, filing written statements), your designated Advocate represents your matter. Personal attendance of clients or company directors is NOT required unless specifically directed by the judge for tender of sworn cross-examination or statement.
What is a Temporary Injunction (Order 39 CPC)?
A temporary injunction is an urgent court order preserving the status quo of the disputed property or rights. It prevents the opposing party from selling, encumbering, or alienating the subject matter while the main suit is pending trial.
What is a Written Statement (Order 8 Rule 1 CPC)?
A Written Statement is the defendant’s formal answer replying paragraph-by-paragraph to our Plaint. Under commercial court laws, the defendant has a strict window of 30 to 120 days from summons service to submit their defense, failing which their right to defend is forfeited.
